Session 1:  Estate, Tax, and Long-Term Care Planning Strategies

A comprehensive presentation on estate, tax, and long-term care planning strategies. Attendees will be exposed to concepts that may be new or unfamiliar to them by taking a deep dive into estate planning strategies for the modern family, an overview of Pennsylvania inheritance tax and traps for the unwary, an overview of federal estate, gift and generation skipping tax, and long-term care planning tips and strategies.

Session 2:  Navigating Regulatory Risks: Leveraged and Inverse ETFs

This presentation will review the PA Department of Banking and Securities’ recent enforcement actions taken against financial advisors utilizing leveraged and inverse ETFs.  The speaker will review how leveraged and ETFs are utilized as investment tools, discuss the Department of Banking’s view of these investments, review case examples of recent enforcement actions targeting advisors that utilize these investments in their client portfolios, review the potential penalties for non-compliance, and provide advice to mitigate the risk of non-compliance.

  • Understand the suitability standard being applied by the Pennsylvania Department of Banking to the use of leveraged and inverse ETFs
  • Understand the risks, potential penalties, and outcomes of non-compliance with the Department’s position
  • Learn several strategies to mitigate the risk of being targeted for an enforcement action

Session 1 presented by Brian Hinkle and Will Church

BRIAN J. HINKLE - BIO

Brian is a founding partner of Sigma Legal Advisors and concentrates his practice on estate planning, trust and estate administration, and business succession planning for business owners. Brian works with his clients to prepare effective estate and business succession plans that achieve their personal and business goals through the use of trusts, private foundations, and other tax efficient planning techniques. Brian also works with individual and corporate trustees and executors on all aspects of trust and estate administration matters, ranging from simple to complex. Brian provides guidance with respect to legal, financial, and tax issues associated with individuals who have received substantial personal injury recoveries and who have large lottery winnings.

Brian is a published author and frequent speaker on issues related to trusts and estates and has presented on various topics, including asset protection strategies, the modification of irrevocable trusts, and recent developments in federal estate and gift tax law. He is also an adjunct professor of law at Widener University Commonwealth School of Law. Brian also serves as President of the Central Pennsylvania Estate Planning Council and the Ned Smith Center for Nature and Art.

Brian is licensed to practice in Pennsylvania. He is also admitted to practice in United States Tax Court.

WILLIAM R. CHURCH – Bio

Will joined Sigma Legal Advisors in 2023, after a decade at a prominent local firm. Will concentrates his practice on wealth-transfer planning for individuals and business owners, including estate and gift planning, retirement planning, and business-succession planning. Will also represents fiduciaries and beneficiaries in matters related to the administration of trusts and estates, including contested matters and litigation before the Orphans’ Court. In addition, Will has experience assisting clients to resolve state and federal tax controversies, including in appeals before the Board of Finance and Revenue and the United States Tax Court.

Will has authored materials and lectured for the Pennsylvania Bar Institute and Dauphin County Bar Association on various topics, ranging from administering insolvent estates to understanding the Trust Fund Recovery Penalty under Section 6672 of the Internal Revenue Code. Will is also fluent in Spanish and proficient (formerly fluent) in Portuguese. In his free time, Will enjoys spending time with his family. Will particularly loves introducing his three kids to new cultures, languages, and experiences, and encouraging them to be curious about different parts of the world. Will also has a passion for singing and making music.

Will is licensed to practice in Pennsylvania. He is also admitted to practice in United States Tax Court.

Session 2 Presented by:  Sarah Hyser-Staub

Sarah is a litigation attorney and Chair of the White Collar Defense, Public Corruption & Investigations Group at McNees Wallace & Nurick LLC.  She helps business owners and public leaders navigate crises by safeguarding their rights and protecting them from government overreach.  Sarah’s experience includes:

  • representing witnesses and targets before state and federal grand juries;
  • defending individuals and entities accused of criminal or regulatory violations;
  • defending public officials in proceedings before the Pennsylvania State Ethics Commission;
  • defending financial advisors facing enforcement actions by the Pennsylvania Department of Banking and Securities
  • assisting clients with disputes involving the U.S. Department of Justice, the Pennsylvania Office of Attorney General, the Pennsylvania Department of Banking and Securities, and other state and federal agencies;
  • conducting Title IX and other internal investigations; and
  • providing guidance on compliance with various statutory regimes, including the Pennsylvania State Ethics Act and the Foreign Corrupt Practices Act.

In her civil litigation practice, Sarah defends public and private entities in civil rights cases and represents businesses in complex commercial disputes.  She has represented clients in both state and federal court on breach of contract claims and business torts (including fraud and misrepresentation).  She assists businesses and individuals with obtaining licenses to work as private investigators.  She is also a member of the appellate and post-trial practice group, having handled numerous appeals.

Prior to joining McNees, Sarah was a law clerk for The Late Honorable William W. Caldwell, United States District Judge.  She graduated summa cum laude from Penn State Law in 2013.

Sarah proudly serves as a board member of the Pennsylvania Association of Criminal Defense Lawyers (PACDL).  She is an Events Committee Chair for the Federal Bar Association – Middle District of Pennsylvania Chapter, a member of the Harrisburg Rotary Club, and the Dauphin County Bar Association.  She was  a 2021 recipient of the Central Penn Business Journal’s Forty Under 40 award, and has been regularly recognized by The Best Lawyers in America: Ones to Watch.
